Terms of use

By accessing or using reportoncare.ca(the “Site”), you agree to these terms of use. If you do not agree, do not use the Site. Your continued use of the Site on or after the “Last updated” date at the top of these terms is your acceptance of the version then in effect.

You must be at least the age of majority in your province or territory of residence to agree to these terms. If you are younger, a parent or legal guardian must supervise your use of the Site and agrees to be responsible for your compliance with these terms.

ReportONCare gathers and republishes publicly available Ontario long-term care records, including Ministry of Long-Term Care inspection reports, compliance orders, written notifications, and monetary fines, together with care quality indicators published by Health Quality Ontario, and presents them in plain language with links to the original records. The Site is for general information only. It is not a substitute for the official records published by the Ministry of Long-Term Care or Health Quality Ontario, and not a substitute for professional, medical, legal, or placement advice. The Site publishes no ratings, no rankings, and no scores, does not publish “best” or “worst” lists, and does not describe any home as unsafe or otherwise characterize the quality of any home. We report what the Ministry of Long-Term Care and Health Quality Ontario have published, attributed and dated, and we show figures beside the relevant Ontario figure so they can be read in context. Nothing on the Site is a recommendation, rating, or ranking of any home, and nothing on the Site guarantees the quality, safety, or suitability of care at any home. An inspection finding records a moment in time and does not, on its own, describe the quality of care a resident will receive today.

The information on the Site is sourced from third-party government records, including:

• Ontario Ministry of Long-Term Care: public reporting on long-term care home inspections, compliance orders, written notifications, and monetary fines.
• Health Quality Ontario / Ontario Health: care quality indicators drawn from resident assessments.

This data is produced by government bodies and is reproduced by ReportONCare as a public convenience. We do not conduct inspections, generate inspection outcomes, compute the care quality indicators, or independently verify the underlying data.

The data may be:

• Delayed: there is a lag between an inspection occurring and the result appearing in public reporting, and a further lag before it appears on the Site;
• Incomplete: not every inspection, finding, or home may be captured;
• Inaccurate: errors or data-quality issues may exist in the source data;
• Out of date:a home’s current situation may differ from what is shown.

You must verify current information directly with the Ministry of Long-Term Care or Health Quality Ontario before making any decision. ReportONCare is not responsible for placement, care, business, or other decisions made in reliance on the Site, and you assume all risk arising from your use of, or reliance on, the information displayed.

Where the Site shows a plain-language summary of an inspection, that summary is generated with the assistance of an automated artificial-intelligence process, is provided only as a reading aid, may be inaccurate or incomplete, and is not the official record. The original Ministry report, linked on each inspection, governs and prevails over any summary in the event of a discrepancy. See our methodology for how figures are sourced and presented.

Records on the Site are reproduced from public data published by Ontario government bodies, made available under the Open Government Licence – Ontario and the originating bodies’ own terms of use. Government-sourced data remains the property of the originating agencies and is reproduced in accordance with the applicable licence. ReportONCare makes a good-faith effort to provide attribution. If you are an originating authority and believe attribution is insufficient, contact contact@reportoncare.ca.

If you operate a long-term care home, or you believe information about a home is inaccurate, out of date, or attributed in error, contact us with the home’s name and address, the specific information at issue (with a link to the page), what you believe is correct, and the basis for that belief. Send correction requests to contact@reportoncare.ca. We aim to acknowledge within 10 business days and to respond within 30 business days where reasonably practicable.

Because the data is sourced from government bodies, we may not be able to change records that accurately reflect the source. Where the source itself is incorrect, we will direct you to the Ministry of Long-Term Care or Health Quality Ontario, which are the authoritative record-holders, and we will update the Site once the source is corrected.

Republication of public records. ReportONCareacts solely as a good-faith aggregator and republisher of public records produced by Ontario government bodies. We make no independent factual or evaluative claims about any home or operator; the outcomes, dates, findings, and other details shown are reproduced from the originating body’s published records, with only such formatting, plain-language summarization, and presentation adjustments as are needed to display them. Any AI-generated summary is a presentation aid only, is subordinate to the original record, and is to be read together with it. We retain the discretion, but no obligation, to update, correct, redact, or remove any content at any time.

Fair report, privilege, and fair comment. In republishing public-record data in this manner, ReportONCare relies on the protections available under Ontario and Canadian law, including the protection for a fair and accurate report of public official and governmental proceedings recognized by the common law and by the Ontario Libel and Slander Act, qualified privilege, the responsible-communication-on-matters-of-public-interest defence, fair comment on a matter of public interest based on true facts, the truth (justification) of the underlying records, and the public-interest reproduction provisions of applicable open-data licences. The condition, safety, and regulatory record of Ontario long-term care homes is a matter of public interest. Our aim is to report the published records accurately and neutrally, to attribute and date every record, and to link to the original so readers can verify it. Any opinion expressed on the Site is offered as fair comment on facts that are stated or referenced, and not as an assertion of fact.

If you believe any content has lost the protection of a fair and accurate report because it is inaccurate, out of date, or incompletely attributed, tell us under the corrections process above. We will review it promptly against the source and correct, update, or remove it where warranted. Publishing a reasonable letter or statement of explanation or contradiction can, in the circumstances described in the Libel and Slander Act, also be relevant; if you send us a concise, factual response, we will consider publishing it alongside the record.

Copyright and other intellectual-property complaints. If you believe content on the Site infringes a copyright or other right, contact contact@reportoncare.ca with enough detail to identify the work, the page or URL, and the rights claimed. We will review such notices in accordance with the Copyright Act (Canada), including the Notice and Notice regime where applicable.

The Site is provided for personal, non-commercial informational use. You may:

• browse and share individual home pages; and
• link to reportoncare.ca.

You may not:

• scrape, crawl, or bulk-download data from the Site using automated means. This does not apply to well-behaved search-engine and accessibility crawlers that respect the Site’s robots.txt and rate-limit their requests. That exception does not extend to crawlers or agents that collect content to train, test, fine-tune, or augment machine-learning or artificial-intelligence models or datasets;
• use the Site or its data for a commercial data product or service without our written licence;
• republish or redistribute the data in a way that misrepresents its source, accuracy, or timeliness;
• use any portion of the Site to train, test, fine-tune, or develop machine-learning or artificial-intelligence models or datasets without our prior written permission; or
• interfere with, disrupt, or attempt to gain unauthorized access to the Site or its infrastructure.

Nothing here restricts fair-dealing use for journalism, criticism, review, education, research, parody, or satire as permitted under the Copyright Act (Canada), provided such use complies with the open-data licences under which the underlying data is published and does not involve bulk extraction or automated scraping otherwise prohibited above.

The Site design, branding, code, and editorial content of reportoncare.ca are owned by ReportONCare. Government-sourced data remains the property of the originating agencies and is reproduced under their open-data licences. Nothing in these terms transfers ownership of any intellectual property to you.

The Site may link to third-party websites, including government portals and mapping services. Those third parties operate independently under their own terms and privacy policies, and ReportONCare is not responsible for their content, availability, or practices.

The Site displays third-party advertising served by Google AdSense and similar networks, subject to your cookie consent. Advertisers and ad networks operate independently of ReportONCare. The appearance of an advertisement next to any home or record is not an endorsement and does not imply any relationship between the advertiser and that home, and advertisers cannot influence the records we show or how they are presented. The Site, including all content, data, and functionality, is provided “as is” and “as available,” with all faults and without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, ReportONCare disclaims all warranties, including merchantability, fitness for a particular purpose, accuracy, completeness, currency, reliability, and non-infringement.

Without limiting the foregoing, ReportONCare makes no warranty or guarantee that:

• any home listed exists, is currently operating, or is correctly identified;
• inspection outcomes, findings, dates, fines, care quality indicators, or any plain-language or AI-generated summary of them are accurate, complete, current, or correctly attributed;
• the care, services, or conditions at any home are safe or suitable for any person; or
• the Site will be uninterrupted, secure, available, or free of errors or harmful components.

To the fullest extent permitted by law, ReportONCare shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with:

• any injury, illness, harm, or loss arising out of or related to care received at, placement in, or any other interaction with any home listed on or located via the Site;
• your access to or use of, or inability to use, the Site;
• errors, inaccuracies, delays, or omissions in the data displayed;
• any decision made in reliance on the Site, including placement, care, or business decisions; or
• misidentification of any home, or attribution of any record to the wrong home.

To the fullest extent permitted by law, the aggregate total liability of ReportONCare arising out of or relating to the Site or these terms, whether in contract, tort (including negligence), statute, or otherwise, shall not exceed CAD $100.

Carve-outs. Nothing here limits liability for fraud, fraudulent misrepresentation, wilful misconduct, or gross negligence, or for any matter that cannot be limited or excluded under applicable law, including the Ontario Consumer Protection Act, 2002. If you are a consumer, you have statutory rights that these terms do not override. These limitations apply even if a remedy fails of its essential purpose and survive termination.

You agree to defend, indemnify, and hold harmless ReportONCare and its operators from third-party claims, losses, liabilities, and reasonable expenses arising out of: (a) your breach of these terms; (b) your misuse of the Site; or (c) your violation of any law or third-party right in connection with your use of the Site, in each case to the extent caused by your acts or omissions. This does not apply to the extent a claim results from our own negligence, wilful misconduct, or breach of these terms, and is subject to applicable consumer-protection law.

ReportONCare will not be liable for any failure or delay resulting from causes beyond our reasonable control, including natural disasters, acts of government, network or infrastructure outages, failures of third-party providers, or cyber-attacks.

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles. Subject to any non-waivable statutory rights, any dispute arising out of or relating to these terms or the Site shall be brought exclusively in the courts of the Province of Ontario, and you consent to that jurisdiction.

If any provision of these terms is held invalid, illegal, or unenforceable, that provision shall be severed or limited to the minimum extent necessary so that the remaining provisions continue in full force and effect.

These terms, together with the privacy policy, constitute the entire agreement between you and ReportONCare regarding the Site and supersede any prior understandings. If they conflict, the privacy policy governs the handling of personal information and these terms govern all other matters.

Our failure to enforce any provision on a particular occasion does not waive our right to enforce it, or any other provision, later.

We may update these terms from time to time; the “Last updated” date reflects the current version, and your continued use after changes take effect is acceptance of them. We may modify, suspend, or discontinue the Site, or terminate or suspend your access, at any time and without notice. Provisions that by their nature should survive termination, including Sections 3, 5, 6, 7, 9, 10, 11, and 13, survive.
